Sheriff Lee Baca Refuses To Obey The Law

Voters will decide if marijuana is legalized marijuana next month. But Attorney General Holder states that if prop 19 passes, the federal government will come down very hard against the state. Holder went on to say that he will go after every single person with marijuana in California.

Obama Sued Arizona Because State Police Can’t Act as Federal Border Agents. Now, He Wants California Police to Act like the DEA

The interesting part of the equation is the idea that a STATE sheriff can’t work as a FEDERAL agent. The Obama administration has made this clear as it is currently prosecuting the state of Arizona after it created a law which would allow state police to enforce federal law. They can’t. Now with Prop 19, that will (if passed) actually become law in California the day after the election. It doesn’t have to go through the courts or anything, it’s law. So if a Sheriff is refusing to abide by Prop 19 he will actually be breaking the law (and could be charged criminally). In this case they are trying to squirm out of it by saying he will enforce federal law (and he has the backing of Eric Holder), however a State agent can’t just become an agent of the Federal government (as noted in the Arizona immigration case).

One things for certain, there will be a long, and protracted battle in the courts if Prop 19 is passed. It is a long overdue debate which needs to happen. In the meantime, if Prop 19 is passed, marijuana possession, consumption, and cultivation will become LEGAL under state law! That’s why the feds are saying that they will go after anyone even possessing it. Problem is, they don’t have a federal police force on the ground, and the State Police can’t legally go after people who possess marijuana. Every single possession case, cultivation case, and consumption case could be repealed at the state level. State Judges would have to allow the cases go to the Federal level. This means that it would be the Federal government, and Federal courts prosecuting every single marijuana possession case. Every last one. So if the DEA and the Feds think they have the resources to do this, then I say, BRING IT ON!

Also worth noting is the absolutely idiotic comment made by City Attorney Carmen Trutanich “when you ask the question, where are you getting your marijuana, there’s a long pause, a stutter, and no truth.”
hmmm. Perhaps you’re not getting the truth because you’re a city attorney who prosecutes marijuana possession cases. Just a hunch. Idiot.
